Terms & Conditions
The terms of bidding, buying and consigning at Dugout Auctions.
About these terms
Last updated October 29, 2026
These terms apply to everyone who uses the Dugout Auctions website: browsing, bidding, buying and consigning. By creating an account, placing a bid, buying or consigning, you agree to them. "We" and "us" means Dugout Auctions; "you" means you.
Your account
You must be at least 18 and able to enter into a binding contract to open an account. Accounts are open to people in the United States. Keep your password to yourself: you are responsible for bids and purchases made from your account. Please give us accurate details and keep them up to date.
We may limit or close an account that breaks these terms, doesn't pay for its wins, or that we reasonably believe is being misused.
Bidding
A bid is a binding offer to buy the lot at that price. A maximum bid authorizes us to bid for you up to that amount, one increment at a time. If two maximums are equal, the one placed first wins. Bids must meet the increments shown on our How It Works page.
Lots close at the time shown, on our server's clock. A bid in the last 3 minutes extends the close by 3 minutes. A lot with a reserve sells only if the bidding reaches the reserve. The highest bidder at the close wins, at the current price.
We may withdraw a lot, correct an error in a listing, or cancel a sale made in error, at any time before the buyer has paid.
Buy It Now and offers
Buying a lot with Buy It Now, or having an offer or counter offer accepted, is a binding purchase at that price. Offers expire after 48 hours if they aren't answered. We may accept, decline or counter any offer.
Paying for what you win
The price of a lot is the winning bid, the Buy It Now price or the accepted offer. There is no buyer's premium. Shipping, packaging and sales tax are added on the invoice, as shown on the lot page before you bid.
Invoices are due within 7 days and are paid online with PayPal. If an invoice isn't paid on time, we may cancel the sale, offer the lot to another bidder or relist it, and limit the account.
Shipping and delivery
We ship only to verified addresses in California. You can bid from any US state, but you need a shipping address in California to complete checkout. We pack every order carefully and ship it with tracking. If something isn't right when it arrives, contact us straight away with photos and we'll work with you to put it right, which can include a refund when the lot is returned.
Descriptions and authentication
We describe every lot as accurately as we can, with clear photos. Authentication and grades are the opinions of the independent companies that issued them, and certificate numbers can be checked with them directly. Please look at the photos and descriptions carefully and ask us any questions before you bid.
Consigning
When you consign an item, you confirm that it's yours to sell and that what you tell us about it is true. We may decline any item. Our commission is 17% of the hammer price, unless we agree another rate with you in writing, and is deducted from your payout; buyers pay no premium. We pay you after your buyer has paid, by the method you chose, with a statement. Items that don't sell can be relisted or returned to you, as we agree with you.
Using the site fairly
Don't bid on your own items, bid to push up a price, use more than one account to bid on the same lot, or use automated tools against the site. Don't copy our photos or descriptions without permission.
Our responsibility
We run the site with care, but we can't promise it will always be available or free of errors. If a technical problem affects a sale, we may cancel or rerun it. To the extent the law allows, our responsibility for any lot is limited to the price you paid for it.
Changes and governing law
We may update these terms; the version on this page applies to bids and purchases made while it's shown. These terms are governed by the laws of the State of California. Questions about them? Contact us.
